If your complaint falls under the power of the Inspector, you can lodge a complaint online or post the form with the supporting documentation.

The Inspector has the power to investigate complaints against the Independent Commission Against Corruption (ICAC), the Office for Public Integrity (OPI) or the Ombudsman.

There are very strict legislative requirements related to disclosing information about complaints made to the Office of the Inspector.

What sort of complaints can the Inspector investigate?

The powers of the Inspector to investigate complaints against the ICAC or the OPI are set out in Schedule 4 of the Independent Commission Against Corruption Act 2012 (the ICAC Act).

Those powers also apply to the Inspector's role in conducting reviews of relevant complaints about the Ombudsman.

The Inspector can investigate complaints about the conduct of any person exercising (or purporting to exercise) functions and powers under the ICAC Act, and may also exercise the review powers under the ICAC Act when conducting a review into a relevant complaint under the Ombudsman Act.

The Inspector cannot deal with the conduct of public agencies or public officers outside of the ICAC, the OPI or the Ombudsman.

Dealing with the complaint

On receiving a complaint the Inspector will decide whether there is power to consider it.

People lodging a complaint will be contacted by an officer acting on behalf of the Inspector.

On the completion of a review or at any time during the review under the ICAC Act, the Inspector may refer a matter to the relevant law enforcement agency for further investigation and potential prosecution and/or refer a matter to ICAC, the OPI, or the relevant public authority for further investigation and potential disciplinary action against a public officer for whom the ICAC, the OPI or the public authority is responsible.

The Inspector may also publish a statement or recommend payment of compensation if they find that undue prejudice to the reputation of any person was caused by the ICAC or the OPI.

The Inspector may take similar action at the completion of a review or at any time during a review under the Ombudsman Act. The Inspector may also publish a statement or recommend payment of compensation if the Inspector determines that undue prejudice was caused to a person's reputation by the Ombudsman.

Lodging a complaint

Complaints about conduct which the Inspector can investigate may be made by completing the online complaint form or by printing the paper-based form and sending it by post, along with any supporting documentation.
