Call for submissions

The Inspector calls for submissions to inform their Annual Review.

The Inspector is responsible for reviewing the operations of the Independent Commission Against Corruption (ICAC), the Office for Public Integrity (OPI) and Ombudsman SA (the SA integrity agencies).

The SA integrity agencies have very strong powers under the ICAC Act and the Ombudsman Act. Their powers include executing search warrants, compelling evidence and interviewing witnesses. The Inspector’s role is to review the exercise of powers and performance of functions of the SA integrity agencies.

The Inspector’s Annual Review

Each financial year, the Inspector is required to undertake an annual review that examines whether each of the SA integrity agencies has adhered to their legislative requirements and exercised their powers appropriately. The Inspector reports the findings of the annual review to Parliament. The Inspector can also make recommendations to the SA integrity agencies and the Attorney-General.

In an annual review, the Inspector must review the powers exercised by the SA integrity agencies and consider:

  • any evidence of corruption, misconduct or maladministration
  • unreasonable delays in conducting investigations
  • unreasonable invasions of privacy
  • whether any undue prejudice to the reputation of any person was caused
  • whether the practices and procedures of these agencies were effective and efficient
  • whether these agencies carried out their functions appropriately and to prevent or minimise corruption.

What does 'undue prejudice' mean?

The Inspector’s annual review must consider whether undue prejudice to the reputation of any person was caused by an SA integrity agency.

This could mean someone’s reputation has been unfairly impacted by their involvement in an investigation or assessment process by the ICAC, the OPI or Ombudsman SA.
If you feel that you have been unfairly impacted by an SA integrity agency, the Inspector encourages you to report this so that they can review whether the conduct of the agency was appropriate.

If the Inspector finds undue prejudice was caused to someone’s reputation by an SA integrity agency, the Inspector may:

  • publish a statement that will help to alleviate that prejudice
  • recommend that the SA integrity agency pay compensation to the person affected.

This will be determined on a case-by-case basis.

How will my submission be used?

The information you provide in your submission will be used to inform the Inspector’s annual review. Where possible, the information published in the review will be de identified.

While you may choose to make an anonymous submission, we ask that you do share your personal details with the Inspector so that you can be contacted if more information is required.

If you do not provide your contact information, the Inspector may not be able to properly consider your submission or contact you with updates or outcomes.
